1. Acceptance of terms
By using this website and the services of SMART FORGE d.o.o. za distribuciju softwera you accept these Terms of service in full. If you do not agree with them, do not use the site or the services.
2. Definitions
The client is a legal or natural person ordering services. A project is the agreed scope of work. A quote is a commercial offer with price, deadline and specification. A contract is formed when the quote is accepted, by email or signed document. Delivery is the handover of the completed project to the client.
3. Description of services
We provide web design and development, digital visibility and software solutions. Package descriptions and prices are listed on the Pricing page.
4. Ordering process
After an enquiry we agree the scope, deadline and price. Work starts after the quote is accepted and, where agreed, the advance is paid. Changes outside the agreed scope are charged according to the current price list or a separate quote.
5. Payment
Payment methods and deadlines are stated in the quote. Packages usually require an advance, with the remainder due before delivery. Invoices are issued in line with Croatian regulations.
6. Refund policy
Refund terms for payments for website development are described on the Refunds page. For consumers, the statutory right to withdraw from a distance contract is not limited by that policy.
7. Intellectual property
After the final payment the client owns the delivered content and the project source code, except for open-source components which keep their licences. We retain the right to show the project in our portfolio unless confidentiality has been agreed.
8. Warranty and liability
We warrant that the delivered work matches the agreed specification. We are not liable for indirect damage, lost profit or interruptions caused by external providers or force majeure.
9. Hosting and maintenance
Hosting and maintenance are not part of a one-off build unless included in a package or separately agreed. The scope and price of maintenance are stated in the price list.
10. Termination
The client may terminate before completion; settlement follows the Refunds page. We may terminate if the advance is not paid within 7 days, if the client does not respond for 14 days or more after two reminders, or if something unlawful is requested.
11. Jurisdiction and applicable law
These terms are governed by Croatian law. We will first attempt to resolve disputes amicably, and jurisdiction is determined under general regulations. Mandatory consumer protection rules apply to consumers.
12. Changes to the terms
We may change these terms. Changes are published on this page with a new update date, and clients are notified of major changes by email.
